Former abortion doc faces rape charge

Jurors will decide if one-time abortion clinic physician Dr. Malachy DeHenre is guilty of raping a patient.

He was first indicted last December on charges he raped a 21-year-old patient in 1992.  DeHenre was also re-indicted on charges that he murdered his wife, Dr. Rose DeHenre, in 1997 at their home in Laurel.

In 1999, DeHenre's first murder trial ended in a mistrial, with the jury split 11-to-1 in favor of an acquittal.

Prosecutors discovered more evidence and both charges were presented to a grand jury again.

Jury selection is underway for the trial involving the rape charge.  DeHenre is expected to be re-tried for the murder of his wife later this year.
