A Mississippi coast doctor convicted for his role in a multi-million dollar pharmacy fraud scheme will stay behind bars until his sentencing in May. 

An order denying bail for Dr. Albert Diaz was signed by U.S. Magistrate Judge John Gargiulo following a hearing Tuesday.

?According to the order, defendants have no constitutional rights to bail after conviction. It also says Diaz, “has not established by clear and convincing evidence that he is not a flight risk or a danger to any other person or the community."

On March 2, a jury found Diaz guilty on all 16 counts in a federal indictment alleging he was involved in a scheme to defraud TRICARE out of millions of dollars.

The charges included fraud, conspiracy, conspiracy to distribute a controlled substance, distribution of a controlled substance and destruction, alteration or falsification of records in a federal investigation.
