Appeals court affirms dismissal of postconviction-relief motion of Forrest County man

FORREST COUNTY, MS (WDAM) - The Mississippi Court of Appeals affirmed the dismissal of a Forrest County man's second postconviction-relief motion on Tuesday

Domiano Ratcliff pleaded guilty to two counts of armed robbery and one count of aggravated assault after a robbery led to the shooting of a Forrest County man in 2004. Two others were also charged in the crime. Ratcliff was sentenced to a total of 50 years to be served consecutively in the custody of the Mississippi Department of Corrections.

In 2006, Domiano filed a postconviction-relief motion which was summarily dismissed, and he filed a second in 2013, arguing his sentence was disproportionate to two of his co-defendants' sentences. Circuit court summarily dismissed the motion and Ratcliff appealed, but the dismissal was affirmed on Nov. 21 after the Court of Appeals found no error.
