Former jail nurse to stand trial in September

A nurse charged in the death of a George County jail inmate will stand trial in September after withdrawing her guilty plea. 

Carmon Sue Brannan returned to court Monday with a new attorney, and a motion to withdraw her guilty plea. Attorney Mary Lee Holmes said Brannan wants to “have her day in court” because “she is not guilty” of causing the death of Joe Dixon, who was found dead in his jail cell Sept. 24, 2014.

Brannan was accused of withholding medical treatment to Dixon, an insulin-dependent diabetic.

Brannan was scheduled to be sentenced Thursday in George County Circuit Court after pleading guilty to manslaughter in May.

“My client is not guilty. She is withdrawing her plea. She should have her day in court. She's entitled to a full and fair trial,” Holmes told WLOX News Now.

Holmes, who was hired Tuesday, said she is still reviewing the case, but she has filed paperwork with the court asking for a continuance along with a notice of intent to withdraw Brannan’s guilty plea.

“As far as the plea goes, she was stunned by it and the sentence recommendation. She's not guilty of what they are claiming. We are absolutely hoping she will get her day in court, which everybody deserves,” Holmes said.

Based on the plea deal, Brannan did not admit guilt but pleaded guilty to forgo a trial. Prosecutors had recommended a sentence of 10 years in prison.

A new trial date was set for September 18, 2017. Prosecutors said they could not comment on a pending case.
