PETAL, MS (WDAM) - The lawyer for the Petal landlord accused of stealing utilities said his client is innocent.
According to Petal Police, Shirley Lowery is charged with four counts of theft of utilities, three counts of tampering of city water and three counts of building code violations.
Lawyer Tom Fortner spokes to WDAM 7 News Thursday afternoon, and Fortner said Lowery did not steal electricity from the city.
Public works officials said Lowery stole the utilities from his property on Second Avenue.
"Quite frankly, the idea of without any hearing whatsoever, simply making a conclusion that Mr. Lowery's properties are condemned, that's more than likely unconstitutional and illegal on the city's part," Fortner said.
Lowery turned himself in to police July 8 and bonded out the same day.
Lowery is expected to go to be in court in September, officials said.
