Judge ruled Groundworx contract unconstitutional

HATTIESBURG, MS (WDAM) - A chancery judge ruled Tuesday that the contract between the city of Hattiesburg and Groundworx is unconstitutional, and the city doesn't owe the company restitution for breaking the contract.

Judge Ronnie Doleac said that state law prohibits a municipality from lending its credit or financing a private company.

Groundworx officials said the city owed almost $6 million for work already completed, but the ruling said the city is not required to repay Groundworx anything. 

The city council and Hattiesburg Mayor Johnny DuPree approved a multi-million dollar contract with Groundworx earlier this year to provide a land application system for sewer disposal, but the deal went south when the DuPree vetoed the proposed rate increase.
