Truck driver records state trooper, gets out of ticket

(RNN) - A truck driver who was pulled over for honking at a state trooper recorded their exchange, and the officer's tone changed when he was informed he was on video.

Brian Miner said he honked at the trooper because he was using his cell phone and speeding while driving on a wet highway.

Illinois state law allows law enforcement to use cell phones while operating a motor vehicle.

Miner defiantly responded when asked how fast he was driving.

"You passed me. How fast were you driving?" Miner said.

The trooper told Miner he would issue a ticket for unlawful use of a horn, and then the truck driver said he was being recorded.

"Yeah, you are, too," the trooper said.

The trooper left for his patrol car and returned, sans the traffic citation.

"I looked at your record; you got a ticket recently for the one headlight or something, looks like," the trooper said after returning from his car. "I didn't write you a ticket. I didn't want to hurt your record. No violation, no warning, no nothing."

The trooper seemed apologetic and said he didn't remember having his phone in his hand.

The video ends with Miner turning the camera toward himself and delivering a final message.

"And that's what happened when they know you're recording," he said.
