Lawsuit against UA coach Nick Saban's daughter dismissed

TUSCALOOSA, AL (WSFA) -

An assault and battery lawsuit filed against the daughter of University of Alabama football coach Nick Saban is being dismissed by a judge.

Kristin Saban was accused of attacking her roommate over a Facebook post made in 2010.

In his summary judgement order, Tuscaloosa County Circuit Judge James Roberts said Saban, "was justified in using physical force to defend herself from what she reasonably believe to be the use of unlawful physical force by the Plaintiff."

The plaintiff, Sarah Ellen Grimes, was roommates with Saban when on August 29, 2010 they, along with other mutual friends, returned home after a night at a local bar.

Saban is said to have left the kitchen where an argument was taking place, went to her bedroom, locked the door and posted a status update to Facebook saying, "No one likes Sarah, yayyyyy!"

The judge's summary indicates that Grimes, who did not like the post, "began yelling and pounding on the locked door, demanding the post be removed."

Saban is said to have opened the door to show that the post had been removed, but when Grimes, "got within inches of [Saban's] face, and continued to yell," Saban grabbed by the throat and a physical fight started.

The judge found Saban's actions justified.

""We are happy for Kristen and her family that this nightmare is finally over," said attorney Bob Prince. "The Sabans chose the difficult, but correct, path of refusing to pay ‘hush money' to avoid the negative publicity certain to follow the filing of these frivolous claims."

    Fans were waiting in the parking lot Wednesday outside Hattiesburg High School for tickets to go on sale for the 5A South State Championship Friday night. The Tigers are hosting the Laurel Tornadoes in a I-59 showdown.  The game, a repeat of the "Lil' Brown Jug" game will give the Tornadoes the chance at revenge, after Hattiesburg won the rivalry game 20-14 in August.
