Smyrna firefighter facing charges after allegedly resisting arrest outside bar

Police say they had no choice but to hit an unruly man who was already on the ground. It turns out the man is a firefighter, and that's made this case even more complicated.

That firefighter is still on active duty as his bosses at the Smyrna Fire Department decide what happens next.

But video of the incident has raised serious questions.

Police say 38-year-old Jerry Mosley was asked to leave Sam's Sports Grill on Old Fort Parkway just after midnight Thursday after he was seen pulling down his pants outside on the patio.

According to the arrest report, the responding officer says Mosley had bloodshot eyes and slurred speech.

When police told Mosley he needed to get a cab, he allegedly started cursing and drawing attention to himself.

That's when police told Mosley he was under arrest, which is when he allegedly started resisting arrest by swinging his arm around.

Police say Mosley was taken into custody after a physical altercation.

The Murfreesboro Police Department is standing by its officers, saying they followed policy and procedure when making the arrest.

The police department released a statement, saying, in part: "After reviewing the video and statements from officers involved, department officials believe the level of force applied was reasonable and appropriate."

As of Thursday evening, the seven-year Smyrna firefighter is still on active status at work.

"We're in the process of gathering the facts, and we will get all of them and then we will discuss them with the town manager, and a decision will be made there," said Smyrna Fire Chief Bill Culbertson.

Mosley is scheduled to return to work at Station 6 on Friday following his normal two days off.

Mosley is charged with public intoxication, indecent exposure, and resisting arrest.
