Judge denies latest request to revoke Matt Pitt's probation

SHELBY COUNTY, AL (WBRC) -

A Shelby County judge has denied the request to release Matt Pitt on supervised probation or a monitoring device because the request was filed improperly.

One of Pitt's attorneys, Carmella Penn, filed a request on Thursday asking the court to allow Pitt to be released from jail into supervised probation or be fitted with an ankle monitor.

In the court document, Penn said Pitt "is a minister in the community and is not a flight risk and has attended every court hearing as required."

She said placing Pitt under supervised probation would save the County the expense of his room and board in jail.

On Friday, Shelby County District Judge Dan Reeves denied Penn's motion to reconsider Pitt's bond revocation on the basis that it was not signed.

Pitt, the founder of The Basement Ministry, has been in the Shelby County Jail since August on charges of impersonating a peace officer.

In October, a judge ruled that Pitt's probation would be revoked and he would have to serve his full one-year sentence.

Shelby County D.A. Robby Owens said he believes Pitt would likely be in jail for an additional six to eight months from October since he had already served nearly 60 days before his probation was revoked. He also said if Pitt is a good prisoner his sentence could be shortened.
