Student sues Madison Co. schools over bathroom rape allegations

A 14-year-old girl alleged in court documents that she was raped in the Sparkman Middle School bathroom by another student.

According to the victim's attorney the alleged attacker asked multiple times to have sex with the 14-year-old in the bathroom. The 14-year-old alerted a female school aide, but it's what happened after that resulted in the suit. 

The 17 page complaint spelled out the allegations. In January of 2010, the female victim said she was propositioned multiple times by a 16-year-old male student.  The victim said she alerted a school aide. The suit said the aide advised the victim to go into the bathroom with the alleged attacker. The complaint says the aide was then going to catch the alleged attacker in the act. According to court documents, the aide never followed through, the victim was left alone with the alleged attacker and the 14-year-old was raped.

The 14-year-old filed suit against the Madison County School Board, her attacker, principal, two assistant principals, and the school aide. A federal judge removed everyone from the suit except the school aide and one of the assistant principals. One count of negligence and one count of wantonness remain on the suit after the judge tossed the other causes of action.  

WAFF reached out Madison County investigators, the Madison County District Attorney's office, and Madison County Schools to find out if the allegations were ever investigated criminally. Madison County district attorney Rob Broussard said he checked and no case appears with the alleged attacker's name. He added if the teen was charged in juvenile court those records are sealed and he doesn't have access to them.

A Madison County Schools spokesperson couldn't confirm or deny an investigation. The district did confirm the school aide left Madison County Schools in 2010.

We tried to reach out to the school aide, but the number we were given for her was not connected. We also tried to reach her attorney and are still waiting to hear back.

    One person was transported to the hospital with minor injuries after a crash involving five vehicles in Hattiesburg Tuesday night.  The wreck happened around 6:30 p.m., in the southbound lane of Highway 49, just north of the Hardy Street intersection.  Hattiesburg Police officials said one of the vehicles involved was an 18-wheeler.  Copyright 2018 WDAM.
