There is new evidence in the Mark Woodworth trial.

Woodworth has been convicted twice of killing Cathy Robertson, a farm wife from Chilicothe, MO, in 1990. Both convictions were overturned and he's heading to trial for a third time.

Thursday a witness gave a sworn statement she saw Brandon Hagan pull up next to her about 10:30 p.m. the night of the shooting. Hagan was known as Brandon Thomure at the time. He's the victim's daughter's ex-boyfriend and the two were said to have a "tumultuous" relationship.

Hagan's mother and sister have testified he was with them in Independence, MO, the night of the murder.

The witness said in her statement she told investigators about the sighting in 1990, but nobody ever followed up with her.
