Lamar County judges recuse themselves from Hattiesburg election challenge

Both Lamar County circuit judges have recused themselves from hearing the election challenge trial between Dave Ware and Hattiesburg Mayor Johnny DuPree.

Judge Tony Mozingo says he and Circuit Clerk Leslie Wilson are under the same opinion that state law precludes a sitting judge from hearing an election challenge in his own jurisdiction.

Judge Prentiss Harrell cited judicial economy as the reason, pointing out another judge has already been assigned to hear the case by the state supreme court. That trial by jury is scheduled for July 23rd.

Meanwhile, if you live in Forrest County, you may be getting a summons any day now to be a potential juror in the upcoming trial.

The circuit clerk's office mailed out 350 summons for jury duty Monday following a pre-trial conference by Judge William Coleman. Courthouse officials say they normally send out 250 jury summons but added another 100 for diversity and because of summer vacations.

Judge Coleman hinted Monday that the jury pool may also include 50 Lamar county residents but so far no order has been signed.
