Plaintiffs in fungal meningitis lawsuits have asked a federal judge to freeze nearly $500 million in assets belonging to the New England Compounding Center (NECC), its owners and two related companies, Bernstein Liebhard LLP reports. According to a report from Reuters, Plaintiffs argued that the Massachusetts-based compounding pharmacy and its owners could conceal assets in order to avoid judgment in a growing number of meningitis lawsuits being filed in the federal court system. U.S. District Judge Dennis Saylor held an expedited hearing on Tuesday, November 20th, to determine if the plaintiffs’ request should be granted, but did not issue an immediate ruling.*
According to the U.S. Centers for Disease Control’s most recent update, 490 cases of meningitis and other fungal infections have been reported in people who received epidural steroid injections supplied by NECC. The case count includes 478 cases of fungal meningitis, 34 of which were fatal, in people who received the steroids to treat back pain. Twelve peripheral joint infections were reported in patients who received steroid injections in their hips, knees, shoulders and other joints.**

In a brief submitted to the JMPL on November 7th, NECC indicated it had been named in 28 meningitis lawsuits in various federal courts. NECC said it supports the establishment of a multidistrict litigation, but asked the Panel to consider Massachusetts federal court as the venue for the consolidated proceedings.
