Miss. judge dismisses health care overhaul lawsuit

HATTIESBURG, Miss. (AP) - A federal judge is dismissing a lawsuit in Mississippi that challenges part of the Obama administration's health care law, but giving the plaintiffs 30 days to make changes to their complaint.

U.S. District Judge Keith Starrett ruled Thursday that the several people who filed the suit haven't shown they have legal standing to challenge part of the health law that requires people to purchase insurance or face tax penalties.

The judge has not ruled on whether that part of the law is constitutional.

Earlier this week, a federal judge in Florida ruled the entire health care overhaul law is unconstitutional. Mississippi is one of26 states in that lawsuit challenging the law.

The cases are almost certainly going to be resolved by the Supreme Court.
