High court won't hear appeal in Miss. ballot case

JACKSON, Miss. (AP) - The U.S. Supreme Court on Monday declined to hear an appeal in a Mississippi ballot deadline dispute lawsuit.

The issue raised by Brian Moore was put to rest when Gov. Haley Barbour signed a bill in March that specified a 5 p.m. filing-day deadline for presidential candidates who want on the Mississippi ballot.

Moore had sued the state in 2008. He was the Socialist Party USA presidential candidate in 2008 who wanted on the Mississippi ballot as the Natural Law Party nominee. Moore argued nothing in state law specified papers had to be filed in the secretary of state's office at 5 p.m.

A federal judge threw out Moore's lawsuit, but an appeals court in February reversed the judge's ruling.

The bill becomes law once it's approved by the Justice Department.

The bill is Senate Bill 3058.
