Miss. high court won't hear fondling case

Associated Press - February 4, 2010 3:34 PM ET

JACKSON, Miss. (AP) - The Mississippi Supreme Court on Thursday declined to hear an appeal from a Hernando truck driver who had argued that his guilty plea to fondling a 7-year-old girl was not voluntary.

The state Court of Appeals had ruled against Jimmy Dale Mayhan last June.

Mayhan had claimed that he was poorly advised by his lawyer to plead guilty in 2006. Mayhan was sentenced to 10 years in prison.

Mayhan was charged with fondling four children in 2004 and 2005. He accepted a plea offer and pleaded guilty to one count.

Prosecutors say the fondling took place in Mayhan's home in Hernando and in the sleeping compartment of his truck.
