Conviction upheld in 1996 Tippah County slaying

Associated Press - December 1, 2009 3:54 PM ET

JACKSON, Miss. (AP) - The state Court of Appeals has upheld the capital murder conviction of Charles Wayne Ross in the slaying of a man from the Dumas community in north Mississippi.

Ross was convicted in 2008 in his second trial for the shooting death of Hershel Ray Yancey in 1996. Ross was sentenced to death in 1997. However, the Mississippi Supreme Court ordered a new trial in 2007.

After a second trial in Tippah County, Ross was sentenced to life in prison without parole.

The Appeals Court on Tuesday rejected Ross' claims that the trial judge restricted his lawyer's questioning of prosecution witnesses.
